Terms of service

These are the terms on which we provide Sendrill. The part that matters most is the sending policy: an email platform is only as good as the lists it carries, so the rules about consent are not decoration.

1. Who these terms are with

Sendrill is provided by eSolutions Softhouse Limited, Samou 5, Paphos, Cyprus ("we", "us"). By creating a workspace or sending through Sendrill you accept these terms on behalf of yourself or the organisation you represent ("you").

2. The service

Sendrill sends email campaigns, automations and transactional messages from sending domains you own and verify, through Amazon SES infrastructure we operate. It includes contact management, segmentation, signup forms, statistics, an HTTP API, an SMTP relay and webhooks. We improve and change the service over time; we will not remove something you rely on without telling you first.

3. Your account

You are responsible for everything done under your workspace, for keeping your API keys secret, and for the accuracy of the details you give us. Tell us promptly if you think a key or an account has been compromised, and we will help you rotate it.

4. What you may send

You may only send marketing email to people who gave you their consent, and you must be able to show when and how they gave it. Sendrill records that proof for you; it is your job to make sure it is true.

The following are not allowed, and they are the fastest way to lose an account:

Transactional messages — order confirmations, password resets, invoices — do not need marketing consent, but they must be genuinely transactional. A "receipt" that is mostly a promotion is a promotion.

5. Plans, allowances and billing

Plans are monthly, in euro, and quoted excluding VAT, which is added where applicable. Payment is by card through Stripe, charged at the start of each period, and each plan includes a monthly allowance of emails:

We notify you at 80% and at 100% of your allowance. Once it is used up, campaign sends stop until you move to a higher plan — you will not be billed for a campaign you did not intend. Transactional messages keep going at the per-1.000 rate for your plan, because cutting off order confirmations would damage your business more than an invoice would.

You can change plan or cancel at any time, effective at the end of the current period. We do not refund part-months. If a payment fails we will tell you and give you a reasonable chance to fix it before sending is paused.

6. Deliverability

We do a great deal to protect delivery — authenticated sending domains, warm-up, suppression, complaint monitoring — but no provider can guarantee that an email reaches an inbox. Mailbox providers make that decision, and their main input is how recipients react to your mail. We do not promise any open rate, click rate or inbox placement.

To protect every sender on the platform, we may throttle a send, pause a workspace that crosses our bounce or complaint thresholds, or require a list to be cleaned before sending continues. Where we can, we will tell you first; where a shared reputation is at immediate risk, we may act first and explain immediately afterwards.

7. Your data and ours

Your contacts, content and campaign data are yours. We process them on your instructions as your processor, as described in the privacy notice. We do not sell them, mail them, or use them to train anything. You can export your contacts and their consent records at any time.

The software, the interface and the documentation are ours, and nothing here transfers ownership of them to you.

8. Suspension and termination

We may suspend or close a workspace that breaks the sending rules in section 4, that endangers the deliverability of other customers, or whose invoices go unpaid after notice. Where the breach is fixable, we will say what has to change and give you the chance to do it. You may close your account at any time from the app.

9. Liability

The service is provided with reasonable skill and care, but without a warranty that it will be uninterrupted or error-free. To the extent the law allows, our total liability in any twelve-month period is limited to the fees you paid us in that period, and we are not liable for lost profits, lost business or lost goodwill. Nothing here limits liability that cannot lawfully be limited.

10. Changes to these terms

We may update these terms. For material changes we will give you notice in the app or by email before they take effect, and continuing to use Sendrill after that date means you accept them.

11. Governing law

These terms are governed by the law of the Republic of Cyprus, and the courts of Cyprus have jurisdiction — without affecting any protection consumer law gives you in your own country.
